MO' MART Terms of Service

By accessing or using MO' MART, creating an account, placing an order or using delivery services, you agree to these Terms of Service.

MO' MART provides an online marketplace and local ordering and delivery service. Available products may include supermarket goods, groceries, fresh produce, household items, hardware, agrovet items, animal feeds, school and bookshop products, gas-related products, water refill, beauty products and other permitted retail categories.

Product categories, stock, delivery areas and operating coverage may vary by location and time.

Customers must provide accurate information, protect login credentials, keep phone and delivery details current and remain responsible for activity performed through their account.

Please notify MO' MART if you suspect unauthorised use of your account.

Customers may sign in through Google and are also subject to Google's terms and privacy policies.

MO' MART may rely on information Google provides, such as name, email address and profile image, for identity, account authentication and profile display.

MO' MART aims to provide accurate product names, descriptions, images, quantities, prices and availability.

Images may be illustrative, packaging may change, fresh products may vary naturally, availability may change and typographical or pricing errors may occur. Clear errors may be corrected before fulfilment and affected customers should be contacted where practical.

Prices are displayed in Kenyan shillings unless stated otherwise. Delivery fees may be added, and prices or promotions may change.

Orders are subject to payment confirmation where required. Supported methods may include cash, M-Pesa or other listed methods. Customers must provide accurate payment information, and MO' MART may cancel suspected fraudulent or unauthorised transactions.

Placing an order is a request to purchase. An order may need confirmation, stock may become unavailable, and MO' MART may contact the customer to confirm substitutions, quantities, prices or delivery information.

Orders may be cancelled where stock is unavailable, payment fails, details are incorrect, delivery is unsafe or inaccessible, or fraud is suspected.

MO' MART should seek customer approval for materially different substitutions. Reasonable replacement options may be supplied where the customer has consented.

Delivery coverage depends on supported locations, including Mukurwe-ini and supported surrounding areas as general context. Delivery times are estimates, not guarantees.

Delays can occur due to weather, traffic, demand, rider availability, incorrect addresses or events beyond reasonable control. Customers must provide accurate phone, address, landmark and access details and should remain reachable.

Delivery may fail where the customer cannot be contacted or the location is unsafe or inaccessible. Additional delivery attempts may attract a new fee where appropriate.

Customers should inspect items promptly after delivery. Damaged, missing, incorrect, expired or materially unsuitable items should be reported promptly through available support channels.

Cancellations may be possible before fulfilment. Perishable goods, health, hygiene, safety and tamper-sensitive products may be handled differently depending on their condition and applicable requirements.

MO' MART may review damaged, incorrect, expired or defective items and may request reasonable evidence such as an order number, receipt, photo or product return. Approved refunds may be made through the original or agreed method, and delivery fees may depend on the circumstances.

Fresh and perishable products may naturally vary in colour, size, ripeness, weight and shape. MO' MART makes reasonable efforts to supply acceptable-quality products.

Some products may have legal, safety, age, prescription, handling, installation or usage restrictions. Customers are responsible for using products according to manufacturer instructions and applicable law.

MO' MART may request additional information or decline prohibited transactions. Regulated products should only be sold where legally permitted and operationally supported.

Promotions may have separate rules, may be time-limited and may not be combinable. Obvious abuse may result in cancellation, and MO' MART may correct genuine promotional errors.

Customers must not use MO' MART for fraud, false orders, harassment, impersonation, unauthorised system access, scraping, attacks, discount misuse, interference with website security or illegal activity.

MO' MART branding, logos, layouts, original content, text and graphics are protected and may not be copied or reused without permission.

MO' MART does not claim ownership of manufacturer trademarks or third-party product images.

Services such as Google, Supabase, Vercel, payment providers, messaging services and maps may be governed by third-party terms and privacy policies.

MO' MART may update the website, suspend features, carry out maintenance, change product coverage or experience outages. We do not guarantee uninterrupted service.

MO' MART provides the service using reasonable care, but product availability, delivery estimates and website access may vary.

Nothing in these terms limits mandatory consumer rights under applicable Kenyan law.

To the extent permitted by law, MO' MART is not responsible for indirect or consequential losses arising from use of the service. Nothing excludes liability where exclusion is prohibited by law.

Customers may be responsible for reasonable losses caused by unlawful misuse of the service, fraud, serious breach of these terms or violation of third-party rights.

MO' MART may restrict or terminate accounts for fraud, illegal activity, abusive behaviour, repeated false orders, security threats or serious breaches of these terms.

These terms are governed by the laws of Kenya.
